I hereby authorize Co-West Commodities (CWC) to charge the credit card I provide. Charges will appear on the statement from “Co-West Commodities”. CWC reserves the right to add to Purchaser’s account CWC’s credit card service charges, without notice and at the sole discretion of CWC. A $25.00 fee will be charged on any returned payment. Errors in price, extension and addition subject to correction. Customer agrees to pay late charges on past due balance of 1 1/2% per month or the maximum allowed in customer’s state of residence, whichever is less, and further agrees to pay reasonable attorney’s fees and costs if collections is required.
I agree that if I have any problems or questions regarding any charges from CWC, I will contact CWC’s AR Department at 909-999-7472 or email at AR@co-west.com. I agree that I will not dispute any charges from CWC unless I have already attempted to rectify the situation directly with CWC and those attempts have failed. I guarantee and warrant that I am the legal cardholder for this credit card. I agree to indemnify, defend and hold CWC harmless, against any liability pursuant to this authorization.
Purchaser agrees that within (10) days after receipt by applicant of any goods or services from CWC, Applicant shall notify CWC in writing if such goods or services are non-conforming or defective in any respect. Failure to provide such notice shall constitute a waiver of any claim relating to or arising out of such goods or services and constitute acceptances of such good or services in all respect. All prices on any invoices or statement of CWC shall be deemed accurate if not contested by Purchaser in writing to CWC within ten (10) days after receipt of invoice or statement. Purchaser also agrees that CWC shall under no circumstances be liable to Purchaser for any incidental, consequential, specials or contingent damages including without limitation. Any direct or indirect lost profits regardless of whether any asserted liability is based upon breach of contract, breach of warranty, negligence, strict liability or any other legal theory.
